Acceptable Use Policy

1. Educational Use Only

Proctorly may be used only for lawful educational purposes.

Permitted educational uses may include:

  1. school exams;
  2. online school assessments;
  3. tutoring assessments;
  4. homeschool assessments;
  5. homeschool co-op exams;
  6. course placement or progress checks;
  7. test-preparation assessments;
  8. academic-integrity review;
  9. educational certification-preparation assessments;
  10. other school-authorized or education-related assessments.

Unless Proctorly provides separate written terms for another use case, Proctorly may not be used for employment hiring, workplace monitoring, immigration screening, law enforcement, healthcare eligibility, government benefits determinations, financial eligibility, tenant screening, or unrelated surveillance.


2. Student Monitoring Restrictions

Users may not use Proctorly to monitor students outside an authorized exam or assessment.

Users may not:

  1. activate monitoring without an educational exam purpose;
  2. use webcam or screen monitoring for general classroom surveillance;
  3. use Proctorly to watch students outside an exam session;
  4. use Proctorly to intimidate, shame, embarrass, or harass students;
  5. use Proctorly to collect student images for non-educational purposes;
  6. use Proctorly to collect student information unrelated to the exam;
  7. use Proctorly for personal, disciplinary, or retaliatory surveillance;
  8. use Proctorly in a way that violates school policy or student privacy law.

Users must have authority to use Proctorly with the students they invite.

Users are responsible for providing, obtaining, or coordinating all notices, consents, authorizations, and approvals required by law, school policy, or applicable agreement.

Users may not use Proctorly with students under 13 unless a legally appropriate authorization path exists, such as:

  1. school or district authorization;
  2. parent or guardian consent;
  3. homeschool parent or legal guardian authorization;
  4. another legally valid consent process.

Individual teacher signup does not automatically authorize use of Proctorly with students under 13.


4. Prohibited Uses

Users may not use Proctorly:

  1. for unlawful purposes;
  2. for non-educational surveillance;
  3. to monitor students outside exams;
  4. to harass, shame, embarrass, intimidate, or retaliate against students;
  5. to publish, post, or share student snapshots, ID photos, screen captures, clips, reports, or personal information without authorization;
  6. to make automatic discipline decisions without human review;
  7. to bypass required parent, guardian, school, or student notices;
  8. to avoid accommodation obligations;
  9. for employment hiring or employment screening at launch;
  10. for law enforcement, immigration, healthcare, financial, housing, or government-benefits decisions;
  11. to create biometric identifiers, faceprints, facial templates, or facial embeddings;
  12. to infer race, gender, age, emotion, stress, attention, gaze, disability, religion, or other sensitive traits from student images;
  13. to build advertising or commercial profiles about students;
  14. to sell, rent, or monetize student data;
  15. to upload unlawful, infringing, abusive, discriminatory, or harmful content;
  16. to access another teacher’s, school’s, or student’s data without authorization;
  17. to test, scan, attack, disrupt, reverse engineer, scrape, overload, or interfere with Proctorly;
  18. to bypass Proctorly’s access controls, rate limits, or security measures;
  19. to use Proctorly in violation of a vendor’s, school’s, district’s, or platform’s terms;
  20. to use Proctorly in a way that creates unreasonable privacy, safety, legal, or security risk.

5. Academic Integrity Decisions

Proctorly flags and AI-assisted reports are advisory only.

Users must not treat Proctorly information as automatic proof of cheating, misconduct, identity fraud, or policy violation.

Before taking academic, disciplinary, grading, or misconduct action, users should independently review:

  1. the relevant flags;
  2. timestamps;
  3. snapshots;
  4. short clips, if available;
  5. session context;
  6. student explanations;
  7. technical issues;
  8. accessibility or accommodation issues;
  9. school policy;
  10. any required appeal or review process.

Final academic and disciplinary decisions belong to the educator, school, or institution.


6. Student Images, Clips, and Reports

Users may access student snapshots, ID photos, screen captures, clips, flags, and reports only for authorized educational purposes.

Users may not:

  1. post student media publicly;
  2. share student media with unauthorized persons;
  3. use student media for entertainment, humiliation, or discipline outside authorized school process;
  4. download or store student media outside approved school systems unless authorized;
  5. use student media to train AI systems;
  6. use student media to create facial recognition, biometric, or sensitive-trait profiles;
  7. use student media for marketing without legally valid written authorization.

7. Accommodations and Alternatives

Proctorly may not be appropriate for every student.

Educators and institutions are responsible for determining and providing required accommodations or alternative testing methods.

Users should consider alternatives where a student:

  1. has a disability or accommodation need;
  2. cannot use webcam or screen sharing;
  3. lacks a compatible device;
  4. has unreliable internet access;
  5. has privacy, safety, religious, medical, or environmental concerns;
  6. has a home environment unsuitable for video or screen monitoring;
  7. cannot complete the Proctorly setup flow.

8. Account Suspension and Enforcement

Proctorly may suspend, limit, or terminate access if Proctorly reasonably believes that:

  1. a user violated this Policy;
  2. a user violated the Terms of Service;
  3. a user created a student privacy risk;
  4. a user used Proctorly without required authorization;
  5. a user created a security or abuse risk;
  6. continued access may harm students, schools, users, Proctorly, or third parties;
  7. suspension is required by law, vendor requirement, school instruction, or security necessity.

Proctorly may also remove content, disable features, restrict exports, or preserve information where necessary to investigate misuse, protect students, maintain security, or comply with law.
